These terms describe the rules and regulations for using the smetnik website located at https://smetnik.net.
By using this website, we assume that you accept these terms and conditions. If you do not agree to all the terms and conditions stated on this page, do not continue using the website.
Cancel order:
After submitting the order, the buyer receives a notification by e-mail that the order has been accepted. The message contains a summary of the order and all the necessary information for the buyer about the further purchase process. The message is valid as an informative proforma invoice.
Prices:
All prices on the website are expressed in euros (EUR) and are final. All prices displayed on the website are subject to change without notice.
The sales contract between the provider and the buyer is concluded the moment the provider confirms receipt of the order, namely with an electronic message sent to the buyer's email address. From this moment on, all prices and other conditions are binding for both the provider and the buyer.
These general conditions form an integral part of the contract.
Availability of information:
The provider undertakes to always provide the customer with the following information:

Company identity (name and registered office of the company, registration number and tax number),
essential characteristics of goods or services
product availability (every product offered on the website should be available within a reasonable time),
conditions of product delivery (method, place and deadline of delivery),
all prices must be clearly and unequivocally specified and it must be clearly shown whether they already include taxes and transport costs,
method of payment and delivery,
time validity of the offer,
the period in which it is possible to withdraw from the contract and the conditions for withdrawal,
explanation of the complaint procedure, including all information about the contact person or customer service department
Terms of business:
The general conditions of the smetnik.net online store are drawn up in accordance with the Consumer Protection Act (ZVPot-1), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).
The smetnik.net online store is managed by the company (hereinafter "provider"):

who is also an e-business service provider. The customer is bound by the general conditions valid at the time of purchase (submission of the online order). When placing an order, the user is specifically reminded of the general business terms and conditions and confirms his familiarity with them by placing the order.
Delivery date:
We ship packages every Friday. Orders that are marked as payment by advance invoice are sent in the first available time, when we receive the transfer to our account. Orders placed during weekends and holidays are shipped immediately on the next business day. In the case of products where a longer delivery period is specifically marked, this is taken into account.
In case the buyer chooses the shipping method 'Standard delivery', the smetnik.net store is not responsible for the loss of the delivery service package and does not assume the cost of the order value.
Payment methods:

Shipping costs are listed with the product.
Warning: these conditions and packaging and delivery costs apply only within the Republic of Slovenia.
Issuance of invoice:
The provider must issue an invoice for the supply of goods or services and hand it over to the user.
After delivery and payment of the ordered items, the provider also sends the customer an invoice in pdf format to the customer's e-mail address. The price and all costs related to the purchase are detailed on the invoice. The buyer is obliged to check the correctness of the data before placing the order.
Liability for material errors:
The provider is liable for material defects that the item had when the risk passed to the buyer, regardless of whether it was known to him or not. The seller is also responsible for those material defects that appear after the risk has passed to the buyer, if they are the result of a cause that existed before that. A slight material error is not taken into account.
The consumer's right to withdraw from the contract:
In the case of contracts concluded at a distance, the consumer has the right to unequivocally notify the company by e-mail (info@smetnik.net) or through some other communication channel within 14 days that he withdraws from the contract, without having to give a reason for his decision. This applies to all products that are NOT made to order.
The consumer must return the goods to the company no later than 14 days after the notification of withdrawal from the order. The consumer returns the goods to the address: SMETNIK, Jošt Žužek s.p., Dvorska vas 28A, 1315 Velike Lašče. The only cost charged to the consumer in connection with the cancellation of the order is the direct cost of returning the goods.
The consumer must return the item to the seller (smetnik.neti) undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer.
When returning the goods, the consumer also sends the invoice for the goods and personal data and the transaction account to which he wishes to receive the returned payment. We will refund the payment within 14 days of receiving the notice of withdrawal from the contract.
Legal notice:
The smetnik.net online store and all information on it, images of articles, graphic and video elements on the website are protected and may not be reproduced or used without prior written permission.
Disclaimer:
We reserve the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or hindering the use of the online store. In the event of technical problems on the website, we reserve the right to cancel orders that were affected by the technical error. In case of cancellation of orders, we will notify you as soon as possible and inform you of further steps. You yourself must ensure adequate equipment protection (antivirus, etc.) before accessing and using the website. The buyer must ensure adequate security and confidentiality of the data used to register on the website (e-mail address, password).
Complaints and disputes:
The provider complies with the applicable European legislation on consumer protection. smetnik.net makes every effort to fulfill its duty to establish an efficient complaint handling system and to designate a person with whom, in case of problems, the buyer can contact by phone or e-mail.
The complaint is submitted via the e-mail address info@smetnik.net. The appeal process is confidential. Within five working days, the provider will confirm that it has received the complaint, inform the customer how long it will take to process it and keep him informed about the progress of the procedure.
The provider is aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably.
In the case of judicial settlement of disputes, the court of the consumer's permanent residence is competent.
